Ardent was appointed to prepare a Transport Assessment, Flood Risk Assessment, Utilities Statement and Foul & Surface Water Drainage Strategies to support the outline planning application, with all matters reserved except access, to develop this Greenfield site to provide 75 dwellings.
Although the application had officer recommendation for approval, and the site was included as a Reserve Site in the Draft Submission Local Plan, it was refused by Maldon District Council members on grounds of the impact of development traffic on the amenity of existing residents, connectivity and permeability, and walking distance from local facilities, resulting in a planning appeal being held by means of a Public Inquiry. In addition, following exchange of evidence, a further reason for refusal relating to construction traffic access was introduced.
One of Ardent’s Directors prepared and gave evidence as an expert witness to address these issues, which was tested through cross-examination by MDC’s barrister. This resulted in the Inspector allowing the appeal, concluding that the development was satisfactory, being within acceptable walking distance of shops, schools, bus stops and the railway station, that the impact on amenity would be minimal, and that the proposed means of construction traffic access was satisfactory.
